Terms of service

These terms are an agreement between you and Mole Marketer ("we", "us") for your use of the Mole Marketer website, app, emails and MCP connector (together, "the service"), at molemarketer.com and our older address, tiny-funnel.com. If you use the service for a business, you agree to these terms on its behalf and confirm you are allowed to. If you do not agree, please do not use the service.

Our privacy policy explains how we handle personal data and forms part of these terms.

The service

Mole Marketer gives each business you add its own AI marketing manager. It reads the business context you provide and connect, pitches marketing projects and briefs, writes first drafts and images on request, assigns and schedules work, and includes Funnel Analytics to show what each project brought in. You can also chat with the manager in the app and connect AI assistants to your account through our MCP connector.

The manager plans and briefs the work. It does not post, publish or send marketing on your behalf, and anything that changes what your team relies on is a proposal a person confirms.

We improve the service all the time, so features may change. If we remove something central to what you pay for, we will tell you in advance.

Your account

• You must be at least 16 and able to agree to these terms
• Give us an email address you control. Sign-in works through links sent to it, so keep access to that inbox secure
• You are responsible for what happens under your account and for the people you invite to your organisation, and for the access you give each of them
• Tell us at [email protected] if you think your account has been misused

Plans, trial and billing

• Growth is the only plan: $99 per month for each business, not priced per user. Each business you add is its own subscription seat
• Trial. New accounts get a seven-day trial. Your card is taken at checkout and nothing is charged until the seven days end. Unless you cancel before then, your subscription starts and renews every month
• Billing. Payments are processed by Polar, which acts as our merchant of record. Polar's own terms apply to the payment, and it handles invoices, receipts and sales tax
• AI allowance. Each business has a monthly allowance for AI work. When it is used up, new generation waits until the next month. Unused allowance does not roll over
• Pausing and cancelling. You can pause a business, which stops its billing and its tracking, or cancel through the billing page in your account. Cancellation takes effect at the end of the period you have paid for, and we do not refund partial months unless the law requires it
• Price changes. Growth is introductory pricing. If we change the price, we will tell you at least 30 days before it applies to your subscription

Acceptable use

When you use Mole Marketer, you agree not to:

• Break the law, or infringe anyone's intellectual property, privacy or other rights
• Use the service to create spam, deceptive marketing, malware, or content that is hateful, harassing or sexually exploits anyone
• Install the tracking snippet on a site you do not control, or track people without the notices and permissions the law requires
• Upload or connect content you do not have the right to use
• Try to break into, overload, scrape or reverse engineer the service, get around its limits, or access other customers' data
• Resell the service or use it to build a competing product

We may suspend or limit access if an account breaks these rules or puts the service or other customers at risk. Where we can, we will tell you first and give you a chance to fix it.

Your content

You keep all rights to what you bring to Mole Marketer: your business details, uploaded files, connected sources, analytics data and the projects, briefs and messages your team writes ("your content").

You give us a limited permission to host, copy, process and transmit your content, including sending it to the AI providers and other service providers named in our privacy policy, only as needed to provide and support the service for you. This permission ends when your content is deleted, except for copies held in backups for their normal retention period.

You are responsible for having the rights to your content and for any data you collect about your own website visitors with Funnel Analytics. For that visitor data you are the controller and we process it on your behalf.

AI output

Pitches, briefs, drafts, images and answers from the marketing manager are produced by AI models. As between you and us, you own the output we generate for you, and you may use it as you like, subject to these terms and to any rights others hold in material it resembles.

AI output can be inaccurate, incomplete or similar to content made for others. It is a starting point for your team, not finished or professional advice. Review it before you rely on it or publish it. Mole Marketer does not guarantee any marketing result, traffic, sales or growth.

Third-party services

Some features connect to services we do not run, such as Context Link and the sources you link through it (Notion, Google Drive, YouTube and others), Polar for billing, and AI assistants like Claude or ChatGPT through our MCP connector. Your use of those services is governed by their own terms. When you connect an AI assistant, it acts with your account's access, and what it receives from us is handled under its provider's terms. We are not responsible for third-party services, and a change on their side may affect what we can offer.

Our service and intellectual property

We own the Mole Marketer software, brand, design, channel playbooks and everything else we provide, other than your content and your output. You may use them only to use the service under these terms. If you send us feedback, we may use it freely without owing you anything.

Availability

We work hard to keep Mole Marketer running and your data safe, but the service is provided "as is" and "as available". We do not promise it will be uninterrupted or free of errors. We may need to take it down for maintenance or updates, and we will try to keep that short.

Ending the agreement

You can stop using Mole Marketer and cancel at any time. We may end or suspend your access if you seriously or repeatedly break these terms, if you do not pay, or if we stop offering the service, in which case we will give you reasonable notice where we can.

When your account ends, you can ask us for a copy of your content first. After that we delete it as described in our privacy policy.

Liability

To the extent the law allows:

• We are not liable for indirect or consequential losses, such as lost profits, revenue, data or goodwill
• Our total liability to you for any claim about the service is limited to the amount you paid us in the 12 months before the claim

Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud. If you are a consumer, you also keep any rights the law in your country gives you that cannot be waived.

You agree to cover our reasonable costs from claims made against us because of your content or your breach of these terms.

Changes to these terms

We may update these terms. We will change the date at the top, and if a change is significant we will email account owners at least 30 days before it applies. If you keep using the service after that, the new terms apply. If you do not agree, you can cancel before they take effect.

Disputes

If something goes wrong, please email us first at [email protected] and we will try to sort it out informally. These terms are governed by the law that applies where Mole Marketer is established, without affecting any mandatory protections you have under the law where you live.

General

If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer these terms without our agreement; we may transfer them as part of a sale or reorganisation of the business. These terms and the privacy policy are the whole agreement between us about the service.
